SAN DIEGO - On Sunday the Denver Broncos defensive players were lethargic, flat and unprepared. The largest of the 10 pieces of equipment is an FCC Converter that takes crude oil and converts it into different forms of petroleum products. It is 171 feet, 6 inches long and 36 feet in diameter, and weighs 800 tons.
On June 21, law enforcement personnel from around the nation gathered at the Mississippi Agriculture and Forestry Museum in Jackson to discuss a hot topic - heavy equipment theft. TODAY MARKS a significant anniversary in the history of recorded music. It was on this date in 1948 that CBS engineer Peter Goldmark demonstrated the first long-playing 33 rpm record — a development that revolutionized the music industry. In keeping with the occasion, I thought it might be fitting today to offer a few other bits of recorded-music trivia.. All the way back in the mid-1600s, a French author named Savinien de Bergerac wrote a fantasy tale about a trip to the moon — which included a description of a phonograph and earphones.
Sylla came to music production through a friend from Ivory Coast who wanted to record Cuban songs in an authentic style. “I got into making suggestions about how to go about it, and how to arrange them,” he says. His recording break came with Orchestra Baobab in 1979 at the legendary Golden Baobab studio in Dakar, now part of Xippi studios, run by Youssou NDour. His production role has been shaped by his extensive terms of reference. “I travelled all round central Africa with my parents, and when I was in Paris I collected all these Cuban records, along with soul and other styles, and I think I bring this to artists. “With Baobab in the Seventies, everyone was doing rumba, but I was the man who actually had the huge record collection and was able to point them in the right direction. Salif Keita was looking for something revolutionary, so I suggested putting him in touch with someone from the West who had the same avant-garde approach. That was Francois Breant - and basically I let them get on with it.”

A standout is the timeless “His Eye Is On The Sparrow,” with Keisha MeFarland on vocals. Whitman does an excellent job as lead vocalist, arranger, choir director and mentor to this great cadre of youthful talent.

In the final quarter of 2007, passenger transport saw the largest increase in air transport and the largest decline in city bus transport. Within land passenger transport, the declining trend of bus transport continued. The annual decline in the number of passengers in intercity and city bus transport (-3.9% and -3.5%, respectively) was also similar to the average annual decrease in the last three years (5.9% and 3.3%, respectively). The volume of railway passenger transport in the final quarter of 2007 did not strengthen significantly year on year; the 2.4% growth recorded in 2007 was also only slightly above the three-year average (2.1%). Air transport and airport transport posted vigorous growth in the final quarter of last year (27.6% and 19.6% year on year, respectively). The increases in 2007 (13.7% and 13.3%, respectively) were also somewhat greater relative to the average annual rises in the last few years. In air transport, this also enabled an increase in aircraft fleet (lease of one and purchase of two new aircrafts) and in airport transport, the completion of the first phase of the new passenger terminal and arrival of two new airline companies, which started to fly regularly from Ljubljanas airport last year. Within freight transport, road transport has increased significantly, whereas maritime freight transport is still decreasing slightly, following the boom recorded in this branch two years before. In the final quarter last year, the volume of freight transport by rail decreased by 3.7% relative to the same quarter of 2006, whereas 2007 as a whole saw a solid 6.8% growth, which exceeded the average growth in the last three years (4.6%). Road freight transport strengthened by as much as 19.1% in the final quarter of 2007; the high 13.4% annual growth nevertheless fell short of the annual average of the last three years by almost 2.p.p. Against the background of favourable international trends, maritime freight transport increased by a respective 30.6% and 41.8% in 2004 and 2005, whereas it dropped by a respective 6.4% and 5.2% in 2006 and 2007. The fall in the volume of maritime transport in the final quarter last year (-8.7%) indicates that the slowdown continues. Harbour freight transport in the final quarter and in 2007 as a whole recorded only a slight increase, particularly compared to the high 22.5% growth in 2006 (average annual growth in the last three years totalled 9.5%). Road freight transport by domestic carriers recorded a much stronger increase than railway freight transport over the last few years, largely due to the increasing international transport (see graph). The volume of road freight transport (in tonne kilometres - tkm), which was almost as much as three times greater than railway transport in 2004, increased by 4,728 million tkm until 2007 (by 52.5%), whereas railway transport increased only by 454 million tkm (by 14.4%). In three years, road freight transport became almost four times greater than railway transport; the share of road transport within freight transport rose to 79.2%. Road transport growth strengthened particularly after Slovenias accession to the EU and mainly through increased international transport (see SEM 1/2008: 14). The largest increase was recorded in cross-trade transport and cabotage, by 2,161 million tkm (by 155.2%). International transport of goods loaded in Slovenia increased by 1,323 million tkm (by 49.4%) and international transport of goods unloaded in Slovenia by 937 million tkm (by 35.1%). National road transport in Slovenia increased by a mere 306 million tkm (by 13.5%).
Within freight transport, railway transport rose substantially, while maritime transport dropped by a fifth. Transport of goods by railway surged by 14.9%, and the growth of road freight transport remained strong at 7%. The rapid expansion of land transport is explained by the robust domestic GDP growth and the high increase in harbour transport (10.6%). Roughly in the middle of 2006, the global growth of maritime transport eased off, which led to several quarterly decreases in the volume of this form of transport, including the first quarter of 2007, when the volume of Slovenian maritime transport fell by 19.9%. Over the past three years, the volume of road freight transport enjoyed the highest growth (by more than 50%) within freight transport (railway transport rose by 13.8%), while harbour and maritime transport rose by over 30%. Road freight transport is the main transport activity within the transport, storage, and communications sector, which has also seen the biggest expansion in the last few years. In 2006, the three main transport activities within the transport, storage, and communications sector were road freight transport, which employed 35.8% of workers in this sector, railway transport (15.2%), and the shipping industry (6.6%; both companies and sole proprietors are included, and the latter are also counted as employees). The corresponding shares of value added generated in these three branches are 23.3%, 12.0%, and 6.3%. Looking at the structure of workers employed in transport activities within the sector in 2003-2006, the highest increase of 3.2 p.p. was recorded in the share of road freight transport, while the shares of railway transport and shipping declined by 1.3 p.p. and 2.2 p.p., respectively (a similar direction and intensity of changes was also observed in the structure of value added; see graph). The number of employees in the transport segment of the transport, storage, and communications sector rose by 2,053 to 39,028. In 2006, road freight transport employed 18,807 workers, 2,425 more than in 2003. The number of workers in the forwarding industry fell by 950 to 3,445, while the number of railway workers declined by 326 to 7,985. The decline in the volume of the forwarding industry was largely caused by Slovenias entry to the EU. Data regarding both the volume of transport and the size of the activity are unfavourable in terms of sustainable development, since cargo is still largely being moved from railways to roads, rather than the other way around.

How does it work? Lets compare it with a typical scenario. Mom and Dad are getting a divorce, and they cant agree on anything. Each of them goes to a lawyer to find out what their rights and obligations are. First, the lawyers explain the law, and then send them to mediation to see what they can settle. Mediation is unsuccessful, and the parents go back to the lawyers. Second, the lawyers try negotiating between themselves, but still cant resolve the issues. So, the lawyers launch into the third stage — the litigation process. They hold examinations for discovery and may bring interim court applications. Both sides may hire experts to support their positions. They line up the witnesses, and everyone heads down to the courthouse. There, a judge hears about the family for a few hours or a few days, and makes a decision everyone has to live with for the rest of their lives. The litigation process is expensive, time-consuming, and emotionally draining, with no guarantee that either party will be happy with the outcome. In CFL, the process stops short of the litigation stage — both parties and their lawyers sign a written contract confirming that none of them will go to court under any circumstances. They must negotiate their own settlement. Instead of using their resources to do battle against one another, they jointly hire a team of experts to help them solve their problems. Mom and Dad may meet with a therapist to help them put aside the emotional issues of the divorce. The therapist may work on improving their communication skills so that meetings are more productive. Mom and Dad may also hire a child specialist to identify their childrens needs, and help them build a parenting plan that meets those needs. Mom and Dad both agree to make full financial disclosure, and they may hire a financial planner to help them sort out the dollars and cents of their divorce. The financial planner might present budget alternatives, or present a range of financial planning alternatives. All these experts are neutral third parties and do not favour one side over the other. The lawyers serve several functions in the CFL process. They must make sure each client sticks to the contract and negotiates in good faith. For example, if one learns that his/her client is withholding information, he or she must advise the other side that the process is at an end (to preserve solicitor-client privilege, they reveal no details of the problem). The lawyers also supervise the process, and coordinate the joint hiring of the third party experts. They set the agenda for the four-way meetings with the other party. They familiarize themselves with their own clients needs and fears, and give him or her independent legal advice. When the process is successful, they write up the terms of the negotiated settlement.
The firm limits its practice to family law.
Why do we concern ourselves with such things? The concept of the contract allows people to make commitments between themselves that the state will enforce–the result being future stability of relationships, avoidance of conflict, and general societal harmony. How odd, then, to apply these concepts to family law! It might fairly be said that the whole of family law concerns itself with addressing members of society where relationships are no longer stable, where conflict abounds, and where harmony has ceased to exist. The concept of family, I think, arises only in the context of some directly stated or some implied commitment. A husband promises to share his life with his wife. And despite the undeniable draw of the Internet, people still trust doctors and pharmacists more than advertisements and the Web for information on prescription medications, the survey shows.
“There are [more than] 30 million Americans who have no health insurance and another 20 million who have inadequate health insurance,” says Rep. Louis Stokes (D0Ohio), chairman of the Congressional Black Caucus Health Brain Trust. “It is mandatory that we begin to try and give Americans–particularly minorities–adequate health care as a right.” The Bush plan would give people not covered by Medicaid tax credits, and families making less than $80,000 a year tax deductions to pay for medical costs. He would also pass laws to ensure that even chronically ill patients could receive health insurance. The plan has received a cool reception on Capitol Hill, and alternate proposals, including a full-scale, government-paid national health insurance plan, are under development. But what does America really want for its health care system? The views are many.

Old habits may die hard, but apparently - at least when it comes to celebrating the holidays with co-workers - so do recently acquired ones. Thats what Linda Skole, president of Chez Josef in Agawam, has observed over the past six years. In 2001, the holiday party business took a major hit nationwide when, in the immediate aftermath of 9/11, no one felt much like partying. “Were expecting a very busy holiday season,” Skole told BusinessWest. “A few years back, after 9/11, some groups were holding back and doing fewer parties, but this year theyre coming back, and we have more private parties scheduled this year than weve seen in a while. I think people realize the positive influence these events have on company morale, that employees really do appreciate it.”
Luckily, Ive managed to avoid this particular form of repetitive strain injury. Incredibly, after averaging half a dozen parties a week for almost 20 years, I still love going out. As I squint into the bathroom mirror and put the finishing touches to my “look” - this doesnt take long since Im the spitting image of William Hague - my heart still beats a little faster in anticipation of the evenings entertainment. Since this usually consists of a free meal with a PR woman at some restaurant thats about to go under, followed by the opening of an envelope, you could describe this as the triumph of hope over experience. Nevertheless, the glass of cheap white wine is always half full rather than half empty. One reason for this, at least until I got married last July, was the optimistic belief that I might end up going home with some gorgeous model. Needless to say, this has never, ever happened. After living in New York for five years, and doggedly going to every fashion party I could, I discovered that pulchritudinous cover girls tend not to be very interested in short, balding, British hacks. As a rule, models dont date mortals. In 1999, in the run-up to Christmas in Manhattan, I went to 13 parties and the only time I managed to persuade a beautiful mannequin to stop looking over my shoulder for 30 seconds was when Joseph Fiennes wandered past. Among the New York glitterati, its considered so “trailer park” to gawk at celebrities that whenever one comes near they look anywhere but straight at them. Consequently, when Joseph Fiennes was standing right next to me, the frisky young model I was talking to looked me directly in the eye for the first time that evening. So Divo it is then, which is in one of those wonderfully grand, cream St Jamess buildings although you would not know it from inside. Inside it is velvet-blue curtains that arent so much swagged, as super-douperswagged. If pressed, I would say it had been funded by the sort of big money which imagines that the Eurovision Song Contest is classy. If unpressed, I might even say much the same thing. CURBS ON the import of cut-price cars built outside the European Union are to be abolished, the Government announced yesterday. The move could allow up to 55,000 “grey imports” into Britain next year from Japan and other parts of the Far East. The present single vehicle approval scheme limits grey imports to 50 cars per model. From March next year this will be raised to 1,000 and thereafter increased by a further 1,000 each month until January 2001, when the limits will be abolished altogether. Grey imports are, on average, one-third the price of EU-built cars cars but manufacturers have warned that, since the cars are not imported through franchised dealers, buyers could have difficulty getting spare parts and getting them serviced. The Society of Motor Manufacturers and Traders gave the move a cautious welcome butsaid consumers needed to know what they were buying.
The British motor industry exported more cars than it sold at home last year for the first time in its history. However, the industrys trade balance remained in the red as imported cars took 62 per cent of the 2,025,450 new cars sold in 1996. The surge in exports, fuelled by increasing production at the three Japanese transplant factories in Britain, helped lift total car output to its highest level since 1973. At the same time, official SMMT figures showed that the new car market broke back through the 2 million mark for the first time since 1990. The total of 2.025 million was 4 per cent up on 1995 and the third-highest on record. Ernie Thompson, the SMMTs chief executive, forecast that sales would rise by a further 25,000-50,000 this year despite possible jitters among private buyers in the run-up to the general election. By 2000 the SMMT is forecasting sales of 2.2 million and annual production of 2 million, enabling the industry to wipe out its long-standing trade deficit. In 1995 the industry was in the red to the tune of about pounds 5bn. The rise in output will be partly driven by increased production from Toyota, Nissan and Honda. Toyota, for instance, will start production of a second mid-sized Corolla model next year at its Burmaston plant in Derbyshire. However, British manufacturers are also gearing up to raise production, with Jaguar launching the X200 model from Coventry and Rover preparing to start manufacture of a new small Land Rover, code-named the CB40, at Solihull. The sharp rise in imports from 59 per cent of sales in 1995 to 62 per cent was driven by strong sales to private buyers of models such as the Fiat Bravo and Punto, the Megane and Clio from Renault and the Volkswagen Polo. The three European manufacturers all increased their market share last year at the expense of UK-based manufacturers. Fords market share slipped below 20 per cent for the first time since 1971 while Vauxhalls share fell from 15 to 14 per cent and Rovers from 12 to 11 per cent. The SMMT expects the importers share of the market to remain above 60 per cent this year. However, it said that export production was increasing at twice the rate that imports were rising, meaning an overall reduction in the trade deficit. Last year Britain shipped about 890,000 cars overseas and imported 1.26 million cars. This year imports are expected to rise slightly to 1.28 million while exports are forecast to remain around the same level. Separately, the SMMT said it would press the next government, Conservative or Labour, to introduce financial incentives for car owners to scrap old, environmentally unfriendly models and trade them in for new cars. Principles of international criminal law.
A legal code in a complex society is designed to have several functions. First, it is designed to announce beforehand the rules by which citizens must conduct themselves, on pain of criminal punishment. Second, if a person violates one of these rules of conduct, the criminal law must determine whether the violator is to be held criminally liable. Third, another part of its adjudicatory function, where liability is imposed the law must determine the general range, or “grade,” of punishment to be imposed. It is the first function that is of interest to us here, the socalled ex ante function of the criminal law. The code announces in advance what actions count as criminal; thus the citizenry can use the announcement to guide their actions to avoid criminal conduct. The law, in other words, draws “bright lines” between allowable and unallowable conduct, and those lines enable the citizens to regulate their conduct so they do not break the laws. To use a familiar metaphor, the criminal law specifies what sorts of actions are “out of bounds,” and the penalties for those actions, so the players will “stay in bounds.” The criminal justice system relies on people knowing the law and knowing where the boundaries for their conduct lie. Ignorance does not excuse unlawful conduct, a fact summarized in the phrase “ignorance of the law is no excuse.” Such a rule is defended as a useful means of creating an incentive for citizens to learn the law. Citizens need to know these codes if these laws are to function successfully in an ex ante mode. If, for instance, the code requires that a person who is aware of the location of a felon report that location to the police, people need to know that the code requires such conduct. If the code requires that a person help another person whose life is in danger, then for the code to guide the behavior of the potential rescuer, he or she has to be aware that the code requires that helping action.

Health Alliance Medical Plans last month announced its coverage of two over-the-counter drugs formerly available by prescription only: Wyeths Alavert and Procter Gambles Prilosec OTC. As H.R. 975, the “Bankruptcy Abuse Prevention and Consumer Protection Act of 2003″ (the Act), inches toward almost inevitable enactment, two questions are on the minds of many bankruptcy professionals. First, why single out consumer debtors and not all individuals for “special” treatment? After all, the big money is not with the consumer debtor, but rather with individuals whose debts are not primarily consumer. In addition, the Act will no doubt spawn additional litigation over the definition of a “consumer debt” and whether the debtor has “primarily consumer debts.” Just as important, though, is the question of whether its enactment will result in a large-scale exodus from the ranks of those who now represent consumer debtors. I cannot answer the first question, but as to the second, I am among the pessimistic: It is highly likely there will be a substantial number of consumer bankruptcy practitioners who will opt out. The complex and convoluted, as well as internally inconsistent provisions of the Act provide significant cause for concern. There is a fear among many on the bench that the more experienced practitioners will no longer represent consumer debtors. As one bankruptcy judge remarked to me, he fears that the more careful practitioners will bail out, leaving the courts to deal with the sloppy practitioners and an even larger number of pro se debtors. This will create a domino effect, with bankruptcy judges either taking early retirement or leaving the bench before retirement age. Replacements for those bankruptcy judges who leave the bench will also be drawn from a smaller and, unfortunately, more than likely less-qualified, pool because those who are experienced and knowledgeable will decline to serve for the same reason that those who are serving leave. What is in the Act that will have so many experienced consumer debtor practitioners literally quaking in their boots? There are several provisions-some of minor consequence, and some that should make every consumer debtors counsel shudder. This article looks at some of those provisions that directly affect practitioners who represent consumer debtors and the impact that each may have. (Unless otherwise indicated, references in this article to Code sections are to the Bankruptcy Code, Title 11, as amended by the Act.)

Competing against the big box retailers is a challenge for Kansas small-town businesses, but state programs can help their owners work toward success. “There are so many challenges that face small mom-and-pop or individual business owners,” said Jeanne Stinson, state coordinator for the Kansas Main Street Program. “Theyre faced with huge competition from the big box stores and most of them, I think, in Kansas have learned to live with that competition. Its not going to go away.” “Promotional activities are one of those four points,” she said. “We also look to the organization itself — their group. Who is doing this work and making sure that its adequately funded, that they have the ability to do their advertising and to make assistance to businesses.”

American interest in spirituality is supplementing, not replacing, traditional religion, a new poll shows. Fifty-nine percent of Americans say they are both religious and spiritual, reports Spirituality Health magazine, which commissioned the poll. One in five Americans view themselves as only spiritual, and in that group .47 percent view religion in a negative way. Eight percent of those surveyed said they are solely religious, while 13 percent regard spirituality and religion as completely different. God was viewed by 84 percent in the poll as being everywhere and in everything rather than someone somewhere. Activities considered to be spiritual by those surveyed: prayer (91 percent), attending worship services (81 percent), parenting (80 percent), walking in the forest (67 percent) and making love (52 percent).
Political participation, voting, and seeking office were all down sharply in the second half of the last century. Civic responsibility withered and almost died. Religious institutions of almost every kind are suffering losses of membership and of leadership, and the workplace no longer is a locus of friendship or of loyalty. Informal social connections plummeted, including such markers as entertaining friends at home, eating family meals together, or sharing a night out with another family. Even more important, examples of altruism, volunteering, and philanthropy were declining sharply. As Jewish wealth increases, for example, Jewish giving remains a stable percentage (or a smaller share) of discretionary income. Simple human trust in other people, the expectation of reciprocity and honesty have declined. The need for many more lawyers than practiced a half-century ago is largely because the old hand-shake or gentlemens agreement could no longer be trusted. Putnam suggests many causes for the loss of social capital in the era of the Baby Boomers: pressures of time and money, mobility and urban sprawl, technology and the imperialism of the media, together with many other putative causes. In any case, civic and professional associations, and even national goals and hopes, are inevitably dashed by these findings. Crime, anomie, poorer schools, even bad personal health are all symptoms of declining social cohesion. Not all organizations were ever benign; we know of the Ku Klux Klan and the German-American Bund. But the many ways that Americans met one another face to face, whether bonding with those like themselves or bridging to others across boundary lines, were mostly powerful forces for good. Perhaps religious life most of all depended, and still depends, on a community of people who are not strangers in the dark.
The Spiritual Dimension: Religion, Philosophy and Human Value. By John Cottingham. New York: Cambridge University Press, 2005. xii + 186 pp. $24.99 (paper). He argues that religious adherence is best understood as structured program of moral and spiritual askesis, an interior journey of transformation in which we are gradually freed from the mental and volitional defects that block the path of moral excellence, Such practices are temporally, heuristically, psychologically, and morally prior to the metaphysical doctrines that comprise a religions truth-claims, according to Cottingham (pp. 150-151). By this he means, roughly, that one must already be steeped in the practices of a religious tradition in order to appreciate fully what its truth claims mean, and what it means to live them out. In short, religious truths are “such that to try to grasp them purely intellectually is to avoid them” (p. 11). Perhaps surprisingly-for a work of philosophy, at least-the book culminates with the claim that the spiritual practice par excellence is participation in the liturgy: “For a striking characteristic of the great religions is that their life blood, their very continued existence in the lives of their adherents, derives . . . from repeated practices of prayer and worship, which find an articulate voice in traditional language that contains a very large measure of symbolic and figurative discourse” (p. 163). One of Cottinghams great virtues is his ability to hold together diverse ideas that other scholars keep apart. The synthesis of theoria and praxis is the books major theme, and Cottingham repeatedly emphasizes that his attention to the latter does not mean that he rejects the former. More interestingly, Cottingham also draws both psychoanalysis and the Enlightenment into this synthesis. He sees psychoanalysis as continuous with-indeed, essential to-the quest for moral development and self-knowledge (chap. 4). He also devotes an entire chapter to defending the legacy of the Enlightenment and arguing that a commitment to “free and open debate as opposed to deference to authority” is “an inextricable part of our human commitment to rationality itself,” which is a commitment to “the very essence of our humanity” (p. 116). It is hard to say which is more remarkable: an analytic philosopher defending psychoanalysis, or a religious thinker defending the Enlightenment. The tact that Cottingham does both is a testament to the breadth of his philosophical vision.

A FIGHT to keep specialist plastic surgery facilities in the Black Country for adult patients has failed to win the backing of health authority bosses. The specialist services are currently based at Wordsley Hospital, which is earmarked for closure in 2002. Health chiefs are planning to transfer them to Selly Oak Hospital, Birmingham next summer. Skin patients needing less-specialised treatment would be dealt with at a new unit at Russells Hall Hospital, Dudley while child patients would be treated at Birmingham Childrens Hospital.

In five consolidated cases, passengers alleged airline negligence for personal injuries they received when ( 1) luggage fell from an overhead compartment, striking a passengers head; (2) a woman did not receive the disembarking assistance she requested and was then injured while exiting the plane; (3) a flight attendant hit a passengers shoulder with a service cart; (4) a passenger tripped over luggage allegedly left in the aisle by a flight attendant; and (5) a passenger fell while boarding a motel shuttle bus after being denied passage by an airline. The trial courts held the suits involved the rendering of “services” and were preempted by the ADA. Reversing, the Ninth Circuit noted that although the LI Supreme Court has never defined “service” under the ADA, it has indicated in two cases that the ADA does not preempt most state law tort claims. The court here said that Congresss purpose in enacting the ADA was to achieve economic deregulation of the airline industry. The purpose of the statutes preemption clause is to avoid interference with that deregulation. Nothing in the statutes language or its legislative history indicates that Congresss purpose was to displace state tort law in actions that do not affect deregulation in more than a peripheral manner, the court said. As further support, the court noted the ADA still requires airlines to maintain insurance to pay for bodily injuries to or the death of any person for which they may become liable.
